PRIVACY POLICY





Tape Project Inc. (“Tape” “we,” “us,” or “our”) respects your concerns about privacy.

This Online Privacy Notice (the "Notice") applies to personal data we collect on www.ejecttape.com (the "Site"). The Notice describes the types of personal data we obtain, how we use the personal data, and with whom we share it. We also describe the rights you may have and how you can contact us about our privacy practices.

This policy was created to help you (the user, customer) understand how we collect information, why we collect it, how we use it and the choices you have related to your own data and information. As an internet company, this area can be technical even for us. We have tried to explain it in simple and straight forward terms because we believe that you shouldn’t need to hire an attorney to explain how we’re protecting your privacy.



How We Obtain Information About You




We may collect personal data that you choose to provide to us through the Site, including, but not limited to, your first and last name, physical address, e-mail address, or telephone number, such as when you:

  • Register on the Site, to create a User Account;
  • Fill out a form on the Site;
  • Sign-up to receive direct marketing communications on the Site;
  • Communicate with us (for example, on a social media platform or by sending us an email);
  • Download the Tape app.

When you visit our Site, we also may collect certain information by automated means using technologies such as cookies, non-cookie-based tokens, web server logs, tracking pixels, and web beacons. Cookies are files that websites send to your computer or other Internet-connected device to identify your browser uniquely or to store information or settings in your browser. Your browser may tell you when you receive certain types of cookies and how to restrict or disable certain cookies. Please note, however, that without cookies, you may not be able to use all of the features of our Site and may not be able to purchase products that use a “shopping cart.” Non-cookie-based tokens are encoded URL-based identifiers that track email click-thru activity or time-sensitive password reset keys and will work in scenarios where cookies are disabled or a session has not been initiated.

Where permitted by law, we may acquire personal data about you from third parties. This may include personal data shared between Tape and partners, and/or publicly-available profile information (such as your preferences and interests) on third party social media sites (such as Facebook and Twitter).



Information Related To Discovering Experiences




We may process your name, contact details, and the data on the Site used by you to suggest which experiences available in the Site may be relevant for you.

You may receive marketing communications from us if you have requested information from us or purchased a ticket in our Sites or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have not opted out from receiving that marketing.

Tape may also send mobile integrated push notifications, in accordance with your marketing preferences, for advertising and marketing the Sites, themselves or events on the Site. Such push notifications may also include information on upcoming events that the user may have signed up to, advising of the upcoming start time, venue, or any changes that may concern such experience. These notifications can be turned off through the mobile device notification settings or by using the means set out in the section Opting Out.

If you connect your Facebook account or sign up for other social media integrations whose product features include social notifications (i.e., updates on what your friends are doing on the Site), you may receive these social notifications. You can manage these social notifications by toggling your social settings to private or disconnecting such integration.


We may also collect personal data in other contexts that we will notify you of at the time.


We’re committed to showing you content that’s relevant, interesting and personal to you. To do that, we may (now or in the future) use your information to improve your experience, including:

  • Identify you when you use Tape.
  • Recommend content you might like based on your activity on Tape.
  • Respond to your questions or comments.


We have a legitimate interest in using your information in these ways. It's fundamental to what we do at Tape and necessary in order to make Tape and its features relevant and personalized to you.

We also have a legitimate interest in making Tape safe and improving our product features so you keep finding the inspiration you want. We all benefit when we use your information to:

  • Work with law enforcement and keep Tape safe. We may get requests for account information from law enforcement authorities like the police or courts.
  • Conduct analytics and research on who is using Tape and what they are doing. For example, by logging how often people use two different versions of a feature on Tape, we can understand which version is better.
  • Improve Tape and offer new features.
  • Send you updates (such as when certain activities are happening) and news by email or push notification, depending on your settings. For example, we send weekly newsletters that may include the latest openings you may like. You can decide to stop getting these notifications by updating your settings via the link provided at the bottom of each email.


We have a legitimate interest in using information we collect to customize your Tape experience based on your offsite behavior. For example, if you visit websites of certain types of restaurants, we may suggest similar restaurant events to you in the future. When we identify your interests based on your offsite behavior with cookies, we (or our partners) will obtain any consent that we may need.


In addition to the specific circumstances above, we’ll only use your information with your consent in order to:

  • Send you marketing materials by email, text, or push notification depending on your account or operating system settings. Each time we send you marketing materials, we give you the option to unsubscribe.
  • Identify your precise location and customize the content we show you. For example, if we know that you’re near one of our featured experiences we may show you that experience’s content. You can opt in to this in your device operating system settings.
  • Tell our partners how their content is doing.



Security




Whilst we take appropriate technical and organizational measures to safeguard the Personal Data that you provide to us, no transmission over the Internet can ever be guaranteed secure. Consequently, please note that we cannot guarantee the security of any Personal Data that you transfer over the Internet to us.

We are committed to protecting your Personal Data using appropriate technical and operational measures such as access controls that restrict and manage the ways in which your Personal Data is stored and handled.



Information We Share




We are not in the business of selling your Personal Data. We consider this information to be a vital part of our relationship with you. Therefore, we will not sell your Personal Data to third parties, including third party advertisers. There are, however, certain circumstances in which we may disclose, transfer or share your Personal Data with certain third parties without further notice to you, as set forth in this policy.


We may share personal data you provide to us or that we collect on the Site with:

  • Our partners;
  • A named third party and only where you have given consent;
  • service providers that perform services on our behalf.




How Long We Keep Information




The time period for which we keep personal data depends on the purpose for which we collected it. In all cases we keep it for as long as necessary to fulfil the purposes for which we collected it. We will then delete the personal data, unless we are legally required to retain it or if we need to retain it in order to comply with our legal obligations (for example, for tax and accounting purposes).

Subject to any applicable legal requirements, we typically retain personal data as follows:

  • Personal data you provide to us when you make a purchase through our Site: we keep this personal data in order to process and deliver your purchase, and then we store it securely for seven years.
  • Personal data you provide when you sign-up to receive direct marketing communications: we keep most of this personal data for the duration of our relationship with you until you opt-out or until we do not have any contact with you for two years.
  • Personal data collected for analytics purposes: we keep this personal data for a short period of time necessary for us to carry out the analytics. We anonymize personal data used for analytics, immediately.
  • Website logs: we keep Site audit logs, which may contain your personal data, for several months.




For California Residents:




These additional disclosures apply only to individuals who are residents of California. The California Consumer Privacy Act of 2018 (“CCPA”) provides additional rights to know, delete and opt out, and requires businesses collecting or disclosing personal information to provide notices and means to exercise those rights. The words used in this section have the meanings given to them in the CCPA, which may be broader than their common meaning. For example, the definition of “personal information” under the CCPA includes your name, but also more general information such as age.



Right to Know and Delete

If you are a California resident, you have the right to delete the personal information we have collected from you and the right to know certain information about our data practices in the preceding 12 months. In particular, you have the right to request the following from us:

  • The categories of personal information we have collected about you;
  • The categories of sources from which the personal information was collected;
  • The categories of personal information about you we disclosed for a business purpose or sold;
  • The categories of third parties to whom the personal information was disclosed for a business purpose or sold;
  • The business or commercial purpose for collecting or selling the personal information; and
  • The specific pieces of personal information we have collected about you.

To exercise any of these rights, please submit a request via email to privacy@ta.pe. In the request, please specify which right you are seeking to exercise and the scope of the request and provide proof that you are a California resident and proof of your identity.

To verify your identity, we will request and collect personal information from you to match it against our records. We may ask for additional information or documentation if we feel it is necessary to confirm your identity with the necessary degree of certainty. We may communicate with you through email, a secure message center, or other reasonably necessary and appropriate means. We have a duty as the holder of certain personal information to verify your identity when making requests to know or delete personal information and to ensure that dissemination of that information would not cause harm to you if it were distributed to another person.

We do not provide these access and data portability rights for B2B personal information or employment related personal information collected from California based employees, job applicants, contractors, or similar individuals.



Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt.

We have the right to deny requests under certain circumstances. In such cases, we will notify you of the reasons for denial. We will not provide you with specific pieces of personal information if the disclosure creates a substantial, articulable, and unreasonable risk to the security of that personal information, your account with us, or the security of our systems or networks. In no event will we disclose, if we have collected it, your Social Security number, driver’s license number or other government-issued identification number, financial account number, any health insurance or medical identification number, an account password, or security questions and answers.



Right to Opt-Out



To the extent we sell your personal information as the term sell is defined under the CCPA, you have the right to opt-out of the sale of your personal information by us to third parties at any time. You may also submit a request to opt-out by emailing us at privacy@ta.pe



Authorized Agent



You may submit a request through a designated agent. You must instruct that agent that they will need to state that they are acting on your behalf when making the request, have reasonably necessary documentation, and be prepared to provide the necessary personal information to identify you in our database.



Non-Discrimination



We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods or services, charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, provide you a different level or quality of goods or services or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

We may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels, for example discounts or deals if you sign up to our newsletter. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.



Shine the Light



California’s “Shine the Light” law permits customers in California to request certain details about how certain types of their information is shared with third parties and, in some cases, affiliates, for those third parties’ and affiliates’ own direct marketing purposes. Under the law, a business should either provide California customers certain information upon request or permit California customers to opt out of this type of sharing.

You must put the statement "Your California Privacy Rights" in the body of your request, as well as your name, street address, city, state, and zip code. In the body of your request, please provide enough information for us to determine if this applies to you. Please note that we will not accept inquiries via the telephone, or by facsimile, and we are not responsible for notices that are not labelled or sent properly, or that do not have complete information.




For Nevada Residents



If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by emailing us at privacy@ta.pe with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account.





For EEA Residents




If you have any questions about our data processing activities, you should contact us at privacy@ta.pe

If you think that we haven't complied with data protection laws, you have a right to lodge a complaint with the Data Protection Commission in the EU or with your local supervisory authority.

Because Tape is a worldwide service, we may transfer the personal data of EEA residents to a country outside the EEA. Where we transfer information from the EEA to a country that doesn't provide an adequate level of protection, we’ll only do so under appropriate safeguards to protect your information, like standard contractual clauses.



How and When We Make Changes To This Privacy Policy



We may change this policy from time to time and if we do, we’ll post any changes on this page, with a summary paragraph prior to the introduction. If you continue to use Tape after those changes are in effect, you agree to the new policy. If the changes are significant, we may provide a more prominent notice or get your consent, as required by law.
